Employment Requirements

Strategic Home Health Care, LLC will conduct yearly Criminal Background Checks pursuant to the Family Care Safety Registry (FCSR) and quarterly Employee Disqualification List (EDL) and all applicable regulations to ensure all Personal Care Attendants currently employed have maintained their ability to be employable under these guidelines. Any Personal Care Attendant found to not meet these previously stated guidelines will be terminated immediately.

  • They can apply for a Good Cause Waiver, pursuant to 19 CSR 30-82.060 and RSMo. 192.2495
    All of the other procedures previously listed for potential Personal Care Attendants are applicable.
  • If the Personal Care Attendant is granted a Good Cause Wavier, we will immediately
    verify the Good Cause Waiver with the FCSR and then the process to rehire may begin.
    If the application for a Good Cause Wavier is denied, applicant is immediately
    disqualified.
  • The Personal Care Attendant can reapply whenever the circumstances related to the
    conviction have changed or one time every twelve months.  Strategic Home Health Care, LLC will not employ any applicant with a disqualifying crime, i.e. a class A or B class felony violation of chapter 565, RSMo (Offenses Against the Person); chapter 566, RSMo (Sexual Offenses), or chapter 569, RSMo (Robbery, Arson, Burglary and Related Offenses), or any violation of subsection 3 of section 198.070, RSMo (required reporter that knowingly fails to report abuse or neglect of a resident at a residential care, intermediate care or skilled nursing facility) or section 568.020, RSMo Disqualification List established pursuant to section 660.315, RSMo. These disqualifying crimes are absolutely prohibited from receiving a Good Cause Wavier. Also, any individual placed on the DHSS, EDL is not eligible to receive a Good Cause Wavier.

Strategic Home Health Care, LLC will maintain documentation in our files that verifies the adoption, implementation and enforcement of the following policies in our screening persons for eligibility as a personal care attendant. All Personal Care Attendants (PCAs) must complete an employment application that will include the following:

  1. A question requiring disclosure of all criminal convictions and findings of any guilt or guilty pleas or pleas of nolo contendere except in minor traffic offenses.
  2. A consent to pre-employment criminal record check pursuant to Section 43.540, RSMo.
  3. A consent to a closed record check pursuant to Section 610.120, RSMo.
  4. A statement requiring disclosure of all aliases and social security numbers used by the applicant, and each one will be screened.
  5. A consent and agreement by the personal care attendant that we will maintain in our files copies of all screening information to document the screening and that it was conducted pursuant to State and Federal laws and regulations.
  6. FCSR and EDL checks shall be performed for all aliases and social security numbers utilized by such persons.
